Terms of Service

These Terms of Service (“Terms”) govern your access to and use of IncentiScore AI's website, web dashboard, and mobile applications (together, the “Services”), operated by IncentiScore (“we,” “us,” or “our”).

By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you're using the Services on behalf of a brokerage or company, you're agreeing on its behalf and confirming you have the authority to do so.

You need an account to use most of the Services. You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access.

The Services support different roles — buyer, seller, and agent — each with a different view of the platform. Agents may add clients and share property or deal data with them; buyers and sellers connected to an agent through a shared deal should expect the relevant data on that deal to be visible to their agent, and vice versa. You must be at least 18 years old to create an account.

Some features require a paid plan (currently Pro or Elite, in addition to a Free tier). Paid plans are billed monthly or annually, as selected at checkout, and payments are processed by Stripe — we don't store your full card details.

• Subscriptions renew automatically at the end of each billing period unless you cancel before renewal.
• You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period, and we don't provide refunds for partial periods unless required by law.
• We may change our pricing or plan features going forward. If we do, we'll give you reasonable notice before it applies to your next renewal.
• Elite plans that include additional agent seats are billed per seat as described on our pricing page at the time of purchase.

You agree not to:

• Use the Services for any unlawful purpose, or to violate any fair housing, consumer protection, or other applicable law.
• Upload content you don't have the right to share, or that infringes someone else's intellectual property or privacy.
• Attempt to access another user's account or data without authorization.
• Reverse-engineer, scrape, or use automated means to extract data from the Services beyond normal use.
• Interfere with or disrupt the Services, including introducing malware or attempting to bypass rate limits or security controls.
• Resell or provide the Services to third parties outside your organization without our written permission.

We may suspend or terminate accounts that violate this section.

IncentiScore, IncentiPayment, IncentiRepair, and Just Jack AI use artificial intelligence to analyze the data and photos you provide and generate scores, cost estimates, repair recommendations, negotiation insight, and conversational responses.

This output is decision-support information only. It is not a licensed home inspection, appraisal, engineering assessment, legal opinion, tax advice, or financial advice, and it is not a guarantee of a property's condition, value, or the accuracy of any cost estimate. AI-generated content can be incomplete or wrong. You should independently verify anything material to a real estate decision — including with a licensed inspector, appraiser, lender, or attorney before making an offer, listing a property, or completing a transaction.

Property details shown in the Services may come from public records, listing data, third-party property data providers, or information you or another user enter. We don't independently verify this data and can't guarantee it's current, complete, or accurate. Always confirm key details directly with the listing agent, seller, or an authoritative source before relying on them.

You retain ownership of the photos, documents, notes, and other content you upload to the Services (“your content”). By uploading it, you grant us a license to host, store, process, and display it as needed to provide the Services to you and anyone you share it with (such as your connected agent, buyer, or seller) — including sending it to our AI provider to generate the analysis you requested.

You're responsible for your content and confirm you have the right to upload and share it.

The Services, including our software, design, scoring methodology, and branding, are owned by IncentiScore and protected by intellectual property law. These Terms don't grant you any rights to our trademarks, logos, or brand name beyond what's needed to use the Services as intended.

The Services rely on third-party providers, including Supabase, OpenAI, Stripe, Resend, and Google. We're not responsible for outages, errors, or changes originating from these providers, though we'll work to minimize disruption to you when they occur.

You can stop using the Services and close your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services, with notice where reasonably possible. Sections of these Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SCORE, ESTIMATE, OR AI-GENERATED OUTPUT WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCENTISCORE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY DECISION MADE IN RELIANCE ON INFORMATION FROM THE SERVICES — INCLUDING A REAL ESTATE OFFER, LISTING, OR REPAIR DECISION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

You agree to indemnify and hold IncentiScore harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your content, or your use of the Services in a way that violates the law or infringes someone else's rights.

These Terms are governed by the laws of the United States and the state in which IncentiScore is incorporated, without regard to conflict-of-law principles. Any dispute not resolved informally will be handled in the courts located in that state, and you consent to their jurisdiction.

We may update these Terms from time to time. If we make material changes, we'll update the “Last updated” date above and, where appropriate, notify you by email or an in-app notice. Continuing to use the Services after a change takes effect means you accept the updated Terms.
